Despite the extreme care taken, Special Case gives no guarantee regarding the information, availability, access and use of this website. The user accepts that access to and use of this website, as well as the use of the information provided on this website, is entirely at the user’s own responsibility. Special Case rejects any liability for damage, costs, fees or lost income that arise directly or indirectly from the use of this website. Special Case expressly reserves the right to change the information on the site at any time.

Application

Every order via the website www.Special Case.be leads to a sales contract between the Special Case (hereafter referred to as the ‘seller’) and a client (hereinafter the ‘buyer’).

Order and payment

An order is valid as soon as the buyer receives an order confirmation. Anyone placing an order with the seller is deemed to be of age and declares to agree with the delivery and payment conditions.

All our prices are listed in euros and include 21% VAT. The shipping costs are charged extra but are clearly indicated when the buyer completes and pays his order. The seller reserves the right to change or correct the displayed prices and product information at any time.

Special Case works with a secure payment environment. This payment platform is integrated in the webshop. Payment can be made by credit card (Visa or Mastercard), via Bancontact / Mister Cash, via Maestro, SofortBanking, PayPal or iDEAL (the Netherlands).

Delivery

Products are currently delivered in the European Union. The seller tries to deliver the ordered products as quickly as possible, and gives an indicative delivery time to the buyer. We emphasize that this designation is purely indicative, and that the seller can not be held responsible for delays that are incurred outside of his will. In addition, the buyer is responsible for correctly entering the delivery address.

The deliveries of the seller are made via partner Bpost in Belgium and PostNL + DHL in the Netherlands.

Special Case can not be held liable for delays incurred during the dispatch by Bpost or PostNL. In accordance with the Law of 6/4/2010, the maximum delivery time is thirty days, unless agreed otherwise. If this delivery period is not feasible, the seller must notify the buyer in good time and the buyer has the right to cancel the order, without additional costs. Any amounts already paid will in that case be repaid within thirty days

Reservation of ownership

The ordered goods remain the property of Special Case until the full price, including VAT, shipping costs and other possible costs have been paid. In case of non-payment we reserve the right to take back the goods, by operation of law and at the expense of the buyer

Renunciation right and return

In accordance with the Law of 6/4/2010, the buyer has 14 days to return the purchase of products from the seller. However we offer 30 days Return Policy! The buyer must always inform the seller of this in writing or via email info@specialcase.be and sends the refused products back to the seller at the buyer’s expense. The buyer returns the products in a sturdy package, in undamaged and unused condition, together with a written proof of the purchase.Under no circumstances will unreported or insufficiently stamped return shipments be credited. Custom made cases and wooden accessories cannot be returned.

Items that are returned to us under the conditions described above will be refunded by us within a period of ten working days. Shipping costs, made by us or by you, are not refunded, so you receive the purchase price minus the amount of the shipping costs. However, if it concerns an article that was incorrectly delivered by Special Case, we will take care of the costs for shipping.

Guarantee

The legal warranty period for hidden defects and the guarantee in case of consumer purchase apply to all our articles. We take care of any damage that is the result of deliberate and gross error, but can not be held liable for general or special indirect damage, of whatever nature, suffered by the buyer.

Complaints

We check all our articles before we send them and ensure proper packaging. The buyer undertakes to check the order upon delivery. Never accept packaging that is damaged during transport and check your shipment immediately upon receipt. If you nevertheless find damage to the items ordered by you, we ask you to inform us immediately, if possible we ask for a photo of the damaged article. Never throw away the mail package until you have established that your shipment is in good condition.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, shall be deemed to be no hidden defects, unless the Customer proves otherwise.

Privacy

Ordering at www.specialcase.be inevitably requires that you provide us with your customer data. We use this information to process your order, to deliver and to track the payment. Only if the buyer gives permission for this, the data can be used for advertising purposes, but only addressed to the address
details of the buyer.

These data are not passed on, rented or sold to third parties. The buyer always has the right to inspect and correct these data, regulated by the Privacy Act. Upon request (with a simple e-mail to info@specialcase.be) we will remove your data from our database. If you have questions about this
privacy statement, you can always contact us.

Electronic evidence and separability

All parties accept electronic proof within the framework of their mutual relations (such as e-mail).

If an article of these conditions is declared null and void, this invalidity will not affect the validity of the other articles.

Applicable law

Belgian law applies to all agreements between Special Case and the client.
